Emily B. Tate is an associate in the Litigation Group. She is an experienced advisor to clients in commercial disputes, with a focus on intellectual property matters. She has experience in state and federal courts throughout the country, as well as private arbitrations.
Prior to joining Frankfurt Kurnit, Emily was a litigation associate with the New York office of McKool Smith PC, where she represented clients in both intellectual property and commercial disputes across a wide range of industries, including technology, consumer goods, finance, medical insurance, and cross-border judgment enforcement. She was also an associate at Cahill Gordon & Reindel LLP, where she represented individual clients and major financial institutions in litigations and in investigations by the SEC and the U.S. Department of Justice.
In addition to her commercial litigation work, Emily has a robust pro bono practice seeking justice for victims of domestic violence and representing indigent defendants in federal criminal cases.
Emily was recognized by Best Lawyers in America in the 2025 "Ones to Watch" edition for Commercial Litigation. She is admitted to practice in New York state courts, as well as the District Courts for the Southern and Eastern Districts of New York, and Eastern and Western District of Texas.
Emily attended Boston College Law School. While at Boston College, she wrote an article on inconsistencies in the law as when a copyright becomes enforceable, which was published in the Boston College Law Review, and an article on concerns posed by YouTube's copyright flagging system, which was published in the Thomson Reuters (West) Intellectual Property Law Review.
