Peter A. Devlin is a litigator in the firm's Litigation and Data Strategy, Privacy & Security Groups, where he provides pragmatic counsel and vigorous advocacy in high-stakes privacy, data, and digital consumer protection matters.
Recognized by National Law Journal as a 2023 "Litigation Trailblazer," Mr. Devlin is a strategic and creative advocate whose clients benefit from his technical acumen. He focuses on class action and regulatory defense at the intersection of data, advertising, and consumer trust. He represents platforms, publishers, and brands in matters involving privacy statutes, unfair and deceptive acts and practices (UDAP) and false advertising laws, and emerging theories around dark patterns, AI, and tracking technologies.
Mr. Devlin has also achieved notable success challenging regulations and government action targeting digital platforms, and he regularly handles complex commercial disputes in trial and appellate proceedings involving contracts, fiduciary duties, copyright, trademark, unfair competition, and fraud.
In addition to litigation, Mr. Devlin provides product counseling and risk management in ad tech, AI, gaming, and e-commerce. He advises on risks relating to pixels, web scraping, and generative AI, and assists companies in updating online terms of service to address consumer protection and arbitration issues.
His representative matters include:
- Represented mobile gaming company in investigation by California Privacy Protection Agency (CPPA) alleging violations of CCPA/CPRA.
- Secured favorable early settlement for children's app publisher in consumer class action alleging dark patterns and deceptive design.
- Obtained preliminary injunction for food delivery app platform challenging new City of New York minimum pay regulations.*
- Negotiated pre-suit resolution of class action claims for e-commerce site involving "strike through" pricing advertising practices.
- Represented social media company in state attorney general enforcement action alleging state law privacy violations.*
- Obtained preliminary injunction against internet company for breach of contract and unauthorized use of sports organization's trademarks.
- Represented NFT company in securities fraud class action, successfully compelling individual arbitration.*
- Advised global media company on generative AI, scraping, and copyright issues.*
- Secured summary judgment for national telecommunications company on breach of contract claims against licensee.*
- Represented wire manufacturer in false advertising and antitrust claims against industry leaders and defended against fraud counterclaims.
- Represented former employees of cryptocurrency exchange in New York Department of Financial Services (DFS) investigation.*
Mr. Devlin clerked for the Honorable Dennis Jacobs of the United States Court of Appeals for the Second Circuit and the Honorable Valerie Caproni of the United States District Court for the Southern District of New York. Prior to joining Frankfurt Kurnit, Mr. Devlin practiced at a leading litigation boutique and the litigation department of a global law firm.
Mr. Devlin graduated cum laude from New York University School of Law, where he was a Florence Allen Scholar and Managing Editor of the N.Y.U. Law Review. During law school, he interned with the New York State Attorney General's Bureau of Internet and Technology. Before law school, he worked as a technology consultant helping to design and implement state health insurance exchanges under the Affordable Care Act.
Mr. Devlin is admitted to practice in New York and the United States District Court for the Southern and Eastern Districts of New York and the United States Court of Appeals for the Second Circuit.
