Partner Christopher R. Chase hosts the Table Topic, “Sponsorship Agreements 2.0 Best Practices and Watchouts” at the INTA Annual Meeting in Washington, D.C. Christopher covers not only the grant of trademark rights in a sponsorship agreement, but these additional points: the requirement to always link the brand with the venue/event; what rights are and are not being granted; approval rights for use of the brand’s IP; addressing Term and Termination concerns; maintaining complete (or close to it) exclusivity; requiring protection from ambush marketing; financial concerns and payment terms; force majeure concerns (which are of particular concern since 2020); representations/warranties/indemnification; and legal and equitable remedies.
