Jack Daniel’s Properties v. VIP Products: What Brands Need to Know About the Recent Supreme Court Decision
Recently, the Supreme Court sided with Jack Daniel's Properties in a trademark infringement case ruling that the First Amendment did not protect the "Bad Spaniels" dog chew toy that mimicked the iconic Jack Daniel's liquor bottle. In this webinar moderated by Edward H. Rosenthal, our panel of experts will discuss the decision and its implications including:
-Does the decision impact the Rogers v. Grimaldi test?
-Can parodic product names ever receive First Amendment protection?
-Are consumer perception surveys appropriate in parody and trade dress cases?
-What adjustments should brand owners make to strategies for protecting and enforcing marks?
-How are courts to determine likelihood of confusion in trademark cases that include parody and humor?
-What is likely to happen on remand in this case?
-And much more!
