Navigating the Evolving Cyber Regulatory Landscape
Privacy & Data Security Partner Rick Borden is a panelist during the webinar, “Brave New World: Navigating the Evolving Cyber Regulatory Landscape” hosted by RANE network. As the international system has become increasingly multipolar, geopolitical and national security concerns have begun to shape the boundaries of the internet, heightening compliance risks for companies seeking to navigate competing regulatory frameworks.
Europe created the GDPR, a comprehensive legal framework for its citizens' data rights. The U.S. has not adopted a federal data privacy and protection framework, but several states will start to enforce GDPR-like laws in 2023, and more are likely to follow. China has pursued a radically different approach to cyber regulations, reflecting a much higher level of security. And India is only just beginning to bolster cybersecurity policies amid growing foreign commercial investment.
Countries are also grappling with how to regulate internet content while balancing civil liberties and free speech rights, with several actively pursuing legislation to put more responsibility on social media companies to moderate potentially harmful content. Singapore’s new Online Safety Act went into effect on February 1, and the U.S. Supreme Court is slated to hear arguments in February regarding Section 230, which dictates content moderation practices by social media platforms.
As a result of these varying approaches to regulating cyberspace, businesses will need to grapple with a number of compliance requirements, posing financial, legal, and reputational risks for companies that fail to comply. Rick and the panel of experts discuss what regulatory actions can be expected this year and how companies can best prepare for them.
