What’s Happening in Copyright Law? Part II
Does your business depend on copyright ownership and licensing, or rise and fall with changes in copyright law? Do you use content created by others or worry that your content is going to be stolen? Are you susceptible to copyright claims from third parties or trolls? If so, please join us remotely for part two of the Frankfurt Kurnit CLE (CA & NY credit) update on current hot topics in copyright law. (Note: part one is not a prerequisite for part two.)
When:
August 13th – 2:00 PM EST to 4:00 PM EST
Where:
Frankfurt Kurnit's Webex
Agenda:
1:50 PM – 2:00 PM: Log-in to Webex (access info will be provided)
2:00 PM – 2:30 PM: Ever-Evolving: The Current State of Fair Use Doctrine
Whether a use is a ”fair use” is one of the weightiest judgments a creator or practitioner can make. The familiar four-factor analysis calls for a case by-case examination and nuanced balancing of multiple factors. And a bad call can ignite expensive and unpredictable litigation. This session distills the year’s most important “fair use” decisions in cases involving feature films, live event recordings, marketing materials, class handouts, appropriation art, and more. Presented by: Edward Rosenthal
2:30 PM – 3:00 PM: DMCA Sec. 512: Where It’s Been and Where It’s Going
The well-known safe harbor that facilitates so much of our modern media is under attack from critics who say it favors technology companies. The Copyright Office has recommended changes to swing the pendulum back toward studios, music companies and other copyright owners. What is the future of the DMCA? And what can tech companies and copyright owners do to prepare? We analyze the key cases and the recent Copyright Office report so you can be ready. Presented by: Caren Decter
3:00 PM – 3:30 PM: Taking Con-Troll: Strategies for Dealing with Harassing Copyright Claims
Copyright claims are more pervasive and expensive than ever, with plaintiffs alleging infringement based on the use of photographs, videos, even video games. What theories are defendants using to combat questionable claims? And what can you do to try to minimize the expense and disruption to your business? In this session, we’ll provide ammo to help you avoid and defend against harassing copyright claims and review some recent decisions. Presented by: Craig Whitney
3:30 PM – 4:00 PM: Speed Round: A Run Through Other Hot Topics
From Stairway to Heaven to Cathy’s Clown: The latest in music copyright litigation, incidental or de minimis use, and copyright termination. We review the most recent developments in these active areas and give you the pointers you need. Presented by: Edward Rosenthal
