Frankfurt Kurnit Beats Back California Talent Scam Prevention Act Claim
The Frankfurt Kurnit Litigation team registered a big win for our music management clients in a lawsuit brought against them in Los Angeles Superior Court, successfully obtaining summary judgment. The complaint alleged that our clients violated California’s Talent Scam Prevention Act by unlawfully accepting “advanced fees” to manage the career of an aspiring recording artist. We moved for summary judgment on the ground that the claim was barred by res judicata in light of a prior action brought by the same plaintiffs against the same defendants in a federal action in Massachusetts. After a hard-fought battle including several rounds of briefing and hearings, Judge Teresa Beaudet granted our motion and dismissed the case with prejudice.
