‘I have been hunted down by HR reps, lawyers, and comms people:’ Developers discuss the pain and prevalence of side work clauses
Wendy Stryker was quoted in a Game Developer article discussing "side work clauses," also known as "moonlighting clauses," in video game industry employment contracts. There has been increased discussion around these clauses, as many developers believe they are overly restrictive and limit their ability to pursue personal projects outside of their regular jobs. On the other hand, employers argue that such clauses help protect a company's intellectual property and prevent conflicts of interest or ownership disputes.
Stryker explained that if a side project overlaps with the work an employee is hired to perform, a company may have a legal basis to claim rights to that work. She recommends that employees "disclose and get permission," stating, "That's what you do if you want to make it crystal clear what your expectations are around side projects. I see plenty of companies that do draft their agreements that way, because they don't want people doing work when it's not clear that the company and the employee are on the same page about whether it's allowed or not." Being upfront with an employer about personal projects and expectations helps ensure that both parties understand any legal restrictions that may apply. She also noted that companies approach side work in different ways and, under federal law, generally seek to prevent employees from "double dipping" by taking on jobs or personal projects that fall within the scope of their employment.
