Protect Your Brand from the New XXX Domain Registry
The .xxx registry will soon open to the public. At that time, registrants will be able to purchase .xxx domains just as they now can purchase .com domains.
This causes a concern for trademark and brand owners as third parties will be able to register your BRAND.xxx. For example, a member of the adult entertainment industry may register your BRAND.xxx as a means to drive traffic to its site with adult entertainment content.
To address the concerns of trademark owners who do not want their brands to become a BRAND.xxx domain, the XXX registry has created a “sunrise” opt-out period. If you have a registered trademark you can block that identical mark from the pool of available .xxx domains. This means that third parties would be prevented from registering your brand as a .xxx.
The opt-out period is open now and expires on October 28, 2011. The procedure is relatively quick and easy, and there is a one-time registry fee ranging from $199 to $350 (depending on your website registrar) for a 10 year block.

New California Law Restricts Use of Words “Purchase” & “Buy” for Licensed Digital Goods
On September 24, Gov. Gavin Newsom signed into law AB 2426 (effective Jan. 1, 2025), a consumer protection bill that expands the scope of false advertising in California. In short, AB 2426 prohibits interactive entertainment and digital media companies from using words like “buy,” “purchase,” or any other words that indicate unrestricted ownership over digital goods.
