Frankfurt Kurnit Law Firm Adds New Partner in Interactive Entertainment Group
"Sean is one of the leading video game lawyers in the United States and we are absolutely thrilled that he is joining us," said Frankfurt Kurnit Managing Partner Jeffrey Greenbaum.
Mr. Kane has extensive experience representing clients in transactions involving entertainment, communications and consumer products such as video games, virtual worlds, mobile apps, social media, computer software, the internet, music publishing, motion pictures and television. Mr. Kane is a member of the American Bar Association Section of Intellectual Property Law, where he recently served as Chair of the Computer Games and Virtual Worlds Committee. Additionally, he is a member of the Section of Science & Technology Law, where he recently served as Chair of the Virtual Worlds and Multiuser Online Games Committee.
Mr. Kane represents a wide variety of interactive entertainment and gaming companies such as FremantleMedia North America Inc., SEGA of America, Inc. and NAMCO BANDAI Games America Inc.
Mr. Kane has published numerous articles on interactive entertainment, including the 2012 Law360 piece, “Video Game Battle: 1st Amendment Vs. Right of Publicity.” He is the author of the 2010 White Papers, A State-by-State Guide to Business Incentives for Your Interactive Entertainment Production, and A Guide to Business Incentives for Interactive Entertainment Production in Canada. He also authored the chapter, “Virtual Property, Real Law,” for the book Settlers of the New Virtual Worlds (2008, BookSurge Publishing). Law360 recently quoted Mr. Kane in its 2013 article, “Third Circuit Rules That Free Speech Does Not Outweigh Right of Publicity.”
Mr. Kane has a JD from Fordham University School of Law 1998 and a B.A. from Villanova University 1995.

Frankfurt Kurnit is pleased to announce that its Interactive Entertainment and Data Strategy, Privacy & Security Groups are partnering with the Entertainment Software Rating Board (ESRB) to enhance cooperation between ESRB’s Privacy Certified program and the firm. ESRB Privacy Certified assists companies in the video game and toy industries in implementing and maintaining lawful, transparent, and responsible data collection and privacy policies, as well as practices for the collection, use, and disclosure of personal information and data. In 2001, the Federal Trade Commission approved ESRB Privacy Certified to serve as one of six Safe Harbor programs, overseeing its members’ compliance with the Children’s Online Privacy Protection Act. Content Partners, LLC, a leading independent owner of major studio-distributed films and television shows, has acquired from Medstar Television 400 Forensic Files episodes, and international distribution rights to Forensic Files II. Created by Paul Dowling, the President and CEO of Frankfurt Kurnit client Medstar Television, Forensic Files is a pioneer of true crime television. Frankfurt Kurnit Client Northwell Health Gets Big Win in Battle with NYU Langone Health System
In a battle between two of the largest healthcare systems in the New York metropolitan area, a New York federal court on March 1st handed an early win to Frankfurt Kurnit client Northwell Health. NYU Langone Health System (“NYU Langone”) sued Northwell Health alleging false advertising and trade dress infringement (i.e., infringement of the overall design and appearance of NYU Langone’s advertisements)—under state and federal law.
